Copyright Information:   All images are copyrighted by JAGWAC Photography.  Any unauthorized use of these images may violate copyright laws, trademark laws, the laws of privacy and publicity, and communications regulations and statutes.  A purchased photograph may not be used in any publication, reproduced, in part or whole, displayed, or manipulated in any way without the prior written permission of JAGWAC Photography.  All images are property of JAGWAC Photography and thus JAGWAC Photography reserves the right to use any image for display, publication, or other purposes.

Session Fee: The session fee pays for our time and talent during your photo shoot, as well as the careful hand selecting and editing of each session image.  It also covers your online image gallery*. It does not include any finished portraits, unless otherwise stated.  

Deposit:  The session fee requires a 50% deposit and is due within 5 days of scheduling your session. Your appointment cannot be reserved until the deposit is paid, so please submit the deposit payment along with these forms as soon as possible.  Due to our limited schedule, deposits are non-refundable but may be applied toward a rescheduled session.  The deposit will be forfeited if a session is cancelled without rescheduling or if the session has been rescheduled more than twice.  No-shows will not be refunded, nor will they be rescheduled.

On Location sessions:  Please be aware that outdoor sessions may need to be rescheduled in the event of inclement weather.  If a permit is required to conduct a session in a client’s desired location, the client will be responsible for obtaining the permit and any costs involved.  Locations outside a 20-mile radius of Dalton, Ga. (30721) are subject to a travel fee.  Please contact us for an exact quote, but expect a minimum of $10.00

Under the Weather:  If your child is sick, please call to reschedule.  Sick children do not like to be photographed and we know that you will not love your portraits nearly as much as if he or she was in good health. If you must cancel, please try to do so as soon as possible.  All cancellations and rescheduling must be made by phone, not e-mail or Facebook.

Arrival Time:  Please arrive on time!  It is to your advantage to be on time and ready to start the session.  Starting late means you will have fewer images to choose from.  Clients arriving more than 15 minutes late may be asked to reschedule, and a $25 rescheduling fee will be applied.

Exclusive Photographer:  No camera, camcorder, or other recording device of any kind, other than the photographer’s, is permitted during the portrait session.

*Online Image Proofing Gallery:  Your images will uploaded to your personal image gallery approximately 2 weeks after your session.  You will receive a link and password to your gallery via email (or facebook).  Login and begin proofing your images.  Note any image change you would like to see in the appropriate area, once the changes are made and the images are approved by you, we will make any digital discs you have ordered and move the final gallery to our print gallery for all print orders.  At that time, you (and/or your friends and family) can order prints directly from the website.  If you have a print credit, you will be given a promo code to redeem it at this time.  Please keep in mind, proofing galleries expire 15 days after upload and require a fee of $25.00 to re-upload. We must receive your approval within the 15-day gallery activation period.

Photographic Rendering:  While we do capture many images during your session, you will see only those images selected by the photographer for previewing.  Images with eyes closed, heads turned, duplicates, etc. will not be shown and are removed from our archives permanently.  All images are photographed in color, but are available in black and white for no additional charge.

Basic Touchup: All final images include basic retouching, which include the removal of minor blemishes, small spots or scratches, small bruises, or single stray hairs. Anything beyond that may be considered extensive retouching, and could be subject to an additional artwork fee of $40/hour (minimum one hour). Extensive retouching includes the removal of braces, whitening of teeth, head swapping, substantial acne, or body slimming.  Please contact us to discuss your touchup options.

Portrait Delivery Time:  Please allow 2-3 weeks for your print order to be completed after payment has been made in full.  Canvases, and other specialty items may take longer. You will be notified by email or telephone when your order is ready and we will arrange delivery or mailing of your order.  Orders needed before the 2-3 week time period will be considered “rush orders” and subject to a $25 rush fee.

Payment: All portrait orders must be paid for in full at the time of ordering.  A 5.0% Ga sales tax will be added to your order.  Acceptable forms of payment include cash, check, or money order.  Please make checks payable to JAGWAC Photography.  Returned checks are subject to a $35 non-sufficient funds fee and must be replaced with another form of payment.  Payment plans are available for some sessions. 

All Sales Final: Due to the custom nature of this work, all sales are final.  No substitutions, exchanges or refunds are available after placing your order.  Replacement will only be given in the case of damage caused by JAGWAC Photography.

Reprints: All ordered images are kept on file for one year from the date of your session.  All images that are not ordered will purged from the system and will not be available for ordering thereafter.  Files are archived 30 days after the online gallery expires, and any order placed after that time period requires a $25 retrieval fee. Reprint prices will reflect current price list at the time of reordering.

Prices Are Subject To Change Without Notice: Prices are guaranteed for a period of ?30 days following the date of the portrait session.  Items purchased more than 30 days after the date of the session will be priced according to the most recent price guide.

Satisfaction Guarantee: If you are not satisfied with your images, please notify JAGWAC Photography during the time your online gallery is active.  A re-shoot will be scheduled at no cost to you.  Subjects must wear the same clothing and be photographed at the same location.  If a re-shoot is desired, images from the first session will be deleted and no longer available for ordering.  If you are displeased with the re-shoot, your session fee will be refunded with no obligation.  All images will be purged after a session fee has been refunded.

Limit of Liability: If Jagwac Photography cannot perform its contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to Photographer’s illness or emergency, then the Photographer shall return any deposit or pro-rated session fee to the client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the Photographer. In the event the Photographer fails to perform for any other reason, the Studio/Photographer shall not be liable for any amount in excess of the retail value of the Client’s order..

Right of Refusal: All policies set forth by JAGWAC Photography have been implemented to provide all clients with the best possible service and the best possible price. The points outlined in this document are non-negotiable.  If there are any policies with which you (the client) cannot comply, perhaps JAGWAC Photography is not the right photographer for you.  JAGWAC Photography reserves the right to refuse service to any client who knowingly and intentionally disregards any of the aforementioned policies.
